1. Agreement Overview
These Terms of Service (the “Agreement”) are entered into between Horia Bodeanu Photography (the “Photographer”) and the client(s) (“Client”) identified in the accompanying photography contract (the “Contract”). The Photographer agrees to provide professional photography services as outlined in the Contract, and the Client agrees to adhere to the terms outlined herein.
2. Booking and Payment Terms
– A **non-refundable deposit** of 30% of the total package price is required to secure the booking. The remaining balance is due **4 weeks before the wedding or event date** unless otherwise specified.
– Payments can be made via bank transfer, credit card, or PayPal, as agreed upon at the time of booking.
– If the Client cancels the event, the deposit will be forfeited. If the Client cancels within 30 days of the event, the full remaining balance will be due.
3. Delivery of Photos and Video
– The Photographer will deliver the final images and/or video clips within **8-12 weeks** after the event date, depending on the complexity and size of the event.
– Photos will be delivered via an online gallery, where the Client will have access to download the images. If a physical album is part of the package, the design and delivery timeline will be outlined in the Contract.
– Video clips (if requested) will be delivered within **4-6 weeks** after the event.
4. Additional Services
– Short video clips (3-5 minutes) are available for an additional fee. Details and pricing for this service will be discussed and included in the Contract.
– The Photographer will provide **high-resolution digital files** for personal use, but prints, albums, or other products are available upon request for additional fees.
5. Copyright and Usage Rights
– The Photographer retains the copyright to all images and video footage taken during the event. The Client is granted a **license to use the photos** and videos for personal use only, which includes printing, sharing on social media, and creating personal gifts.
– The Photographer may use any photos or video for promotional purposes, portfolio display, and marketing materials unless the Client requests otherwise in writing.
– The Client may not sell or distribute the images for commercial purposes without the Photographer’s prior consent.
6. Client Responsibilities
– The Client agrees to provide the Photographer with a clear schedule and list of key moments for the event (such as family portraits, ceremony details, etc.) in advance.
– The Client is responsible for securing any necessary permits or location access if required for photography or video shooting.
– The Client must notify the Photographer of any restrictions on the use of photos or video at the venue or event.
7. Travel and Accommodation
– If the event is located more than **50 miles** from the Photographer’s location, additional travel and accommodation fees may apply. These fees will be outlined in the Contract.
– The Photographer will discuss travel arrangements in advance and include any additional charges in the final quote.
8. Force Majeure
– The Photographer is not liable for any failure to deliver services due to circumstances beyond their control, including but not limited to: accidents, illnesses, acts of God, or other emergencies. In the event of such circumstances, the Photographer will attempt to reschedule or offer alternative arrangements but cannot be held liable for any refund or damages.
9. Limitations of Liability
– While the Photographer will make every effort to ensure the quality of the images and video, the Photographer is not responsible for any technical failures, such as equipment malfunction, that might affect the quality or quantity of the final product.
– The Photographer’s liability is limited to the refund of the fees paid by the Client if the services are not delivered, and no other claims or damages will be considered.
10. Changes to the Agreement
– Any changes or amendments to this Agreement must be made in writing and signed by both the Photographer and the Client. This Agreement supersedes any prior discussions or agreements.
11. Dispute Resolution
– In the event of any dispute, the parties agree to attempt to resolve the issue through mediation. If mediation is unsuccessful, the dispute will be handled through arbitration under the jurisdiction and laws of the location where the Photographer resides.
12. Confidentiality
– The Photographer agrees to keep all information regarding the Client’s personal details, event specifics, and any other sensitive information confidential and will not share it without the Client’s consent.
13. Governing Law
– This Agreement will be governed by and construed in accordance with the laws of the country or region in which the Photographer operates.
